How to Handle Mandatory Reporting

As a staff or faculty member of the CU community, you play many different roles. Sometimes, however, those roles can come into conflict. For instance, because you are a visible and trusted person in the community students are likely to come to you for advice, assistance or support. However, if a student discloses that they have been the victim of a crime, you may have a duty to report. Why do you have to report?

It is the policy of UCB, that supervisors who become aware of a complaint of protected class discrimination and harassment and sexual harassment (including sexual assault) or related retaliation, to promptly report it to the Office of Discrimination and Harassment (ODH) if the alleged perpetrator is an employee, or to the Office of Student Conduct (OSC), if the alleged perpetrator is a student. Staff in offices that hold legal confidentiality privileges (such as Office of Victim Assistance) are exempted from this reporting policy.

How do I tell a student that I have to report?

  1. Support FirstIf a student discloses something you believe may be a crime, offer support first. Let the student know that you are there to help them, DO NOT judge or blame. Acknowledge the experience and inform them of resources they can access for support.
  2. Explain your Obligation to report: Explain to the student that while you recognize they are dealing with a difficult situation, you have some reporting obligations.

What do I do if she/he gets upset?

The idea of reporting to may be upsetting to the student.The student may fear that the situation will get out of control or that other people will find out.Assure the student that:

  1. They won’t lose all control:The student does not have to meet with or talk with anyone if they do not want to.Just because a report has been made does not mean that the student has to pursue or engage in the process.
  2. They can choose to have accompaniment when meeting with ODH, OSC, or police (or anyone else):Victim Advocates who are experienced with legal, judicial and medical systems can be called to accompany victims and victim-witnesses in all meetings.
  3. Tell them you will not be telling everyone what they have disclosed:Let the student know that you will not disclose their information to anyone who does not need to know (such as friends, other classmates, RA’s etc.)
  4. There are confidential resources to help her/him:provide the student with information for the confidential offices on campus.

Other Options:

“I think I know where you are going with this…”

If you suspect that a student might be getting ready to tell you that they have been the victim of a crime you might consider doing the following:

  1. Say to the student: “I think I know where you are going with this.While I absolutely want to support and listen to you, I need to let you know that I may not be able to keep your information confidential.If this is something that you don’t want anyone else to know about we can call somebody right now who is confidential.” Make sure you let the student know that you want them to be heard!
  2. If the student agrees you can contact the Office of Victim Assistance, 303-492-8855, an advocate can meet with the student in our offices, or come to you.

“Don’t use names…”

If a student feels they cannot wait to talk to a confidential staff person you might consider doing the following:

  1. Ask the student to talk generally to you about the situation and encourage them to not give the names of the people involved.You will still be required to report but she/he will maintain a greater level of control over the situation.
  2. Encourage the resident to make contact with a confidential office for support and resources.

Caring for yourself in Grief

• Sleep. Regular rest is very important. If you have trouble sleeping, try drinking a
glass of milk or listening to soothing music. Sometimes journaling can help to
transfer racing thoughts from the head to paper. Find what works for you.
• Eat Well. Be sure to eat well-balanced meals. Seek out people with whom you
will be comfortable to share mealtimes as often as possible. Eat meals
intentionally; do not rely on snacks or simply eating in front of the television.
Gradually your appetite will return.
• Drink Well. Drink plenty of water and herbal teas; avoid caffeinated drinks or
• Exercise. Get some exercise, whether walking , T’ai chi, swimming, or any
physical activity. Exercise helps you release some of your tension. It will help you
feel stronger.
• Breathe. Take “time-outs” and breathe deeply and fully two to three times in the
midst of your activities.
• See your Physician. If you are not feeling well, see your primary care physician.
Grief takes a toll on your body, and you may be susceptible to illness. Do not
hesitate to check it out.
• Find Friends. Find people who are comfortable with your grief and will let you
experience your feelings, whether that is crying, telling your story again and again,
or sitting with you in silence.
• Be Patient. Try to be patient with people who do not understand your pain. Be
patient with yourself as well.  Grief takes time.
• Do Something with your Feelings. Find an outlet for your feelings. You may
want to try journaling, which is a good way to externalize all that is going on inside
of you. Some people find creative outlets, such as painting, sculpting, or writing
and playing music. Others may just find talking to be the best outlet. Find what
works for you.Allow Yourself Time to Grieve. Allow yourself grieving times. Try to declare
other times non-grieving times. This way you may find at least short times of
• Pamper Yourself. Set aside time each day to do at least one activity that brings
you comfort and feels like you are pampering yourself. Even if it does not bring the
pleasure it used to bring, it will help you relax and begin to heal.
• Physical Contact. Ask for hugs, get a massage or take a hot bubble bath to get
some physical comfort.
• Look to Nature or· Animals. Nature and pets can be healing. Tune into the
cycles of nature. Absorb the beauty and wonder of the natural world.
• Find Your Coping Skills. Draw on your memory of past experiences that were
difficult. What you learned then can help you now. Learn what you can do when
the pain overwhelms you. Try not to let helplessness take over.
• Be Gentle with yourself. Above all, be gentle with yourself. Pretend you’re a
friend who needs your help and support. What would you do for them?

Bias Motivated Incidents

General Information

Bias motivated incidents involve behavior, speech, or expression that is motivated by bias based on perceived race, religion, ethnicity, national origin, sex, gender identity, gender expression, disability, age, veteran status, pregnancy, political philosophy or affiliation,  or sexual orientation and has a negative impact. Incidents of bias can take many different forms and the impact can vary. Comments or actions that are degrading or devaluing may be considered to be bias incidents. The important thing to note is the impact on the person experiencing the incident.

A bias motivated incident could constitute a hate crime in the criminal justice system. In addition it may constitute protected class discrimination or harassment under CU policy. Regardless of the form, if you feel that you have experienced bias the Office of Victim Assistance (OVA) can offer support.

What to Do

If you feel that you have been the target of a bias motivated incident you may have questions about what your options are. Bias is pervasive and can take many different forms. Depending on the nature of the incident you may have specific needs such as reporting, support, housing or academic concerns.


Experiencing bias in general can take a toll on your day to day life. Taking care of yourself may involve getting help; seeking support takes many different forms. Individuals who are the target of bias often look to their communities first for understanding and advice. There is often important historical or anecdotal information about how the impact of bias has played out in your community in the past, as well as about the strategies people have used to resist or engage with it. If you haven’t found community connections at CU this might be a time to seek those out. OVA staff is willing to help you find connections.

Discussing the situation with someone may help you sort out your feelings and decide what to do. While you may want to talk to someone you trust, such as a friend, co-worker, family member or spiritual advisor, there are also resources available on campus. You may seek out a supervisor, professor or individual in a position of power to help remedy the situation but keep in mind that if you tell a university employee they may have a supervisory duty to report.

When you seek help from professionals, first ask what their confidentiality is, and who they are required to tell if you were to disclose your situation. That way, you can make an informed decision.

Some things you might discuss:

  • figuring out what you feel and think about what’s going on.
  • getting information that will help you assesses the situation, and figure out what you want.
  • talking about how to manage your academics, or work given your situation.
  • talking about making a safety plan if applicable. There are many strategies available.
  • getting medical treatment if you have injuries or are worried about your health.
  • changing where you live to get some space, or safety. There is community help with this.
  • reporting to the police or the CU Office of Institutional Equity and Compliance if appropriate.

If you are not ready to talk to somebody but want to get more information about your situation, the web is a great place to do that. If you are concerned about privacy, you should know that most computers keep track of websites you visit. There is a lot of useful information on the web, and it might be best to seek these resources on a public computer such as at a lab on campus, a public library or at a friend’s house.

If you are worried about how this situation may be impacting your schoolwork, that’s important to notice. You deserve to be in school and to meet your goals. For instance, it can be extremely difficult to concentrate in class especially if the person enacting the bias is the professor, or a fellow student in the class. OVA can discuss options for managing academic issues while maintaining privacy. There are concrete things the University can do to help with your situation.

Protective Orders

A protective order is a legal document obtained through the courts that puts restrictions on individuals who may be dangerous to you. If they violate these restrictions they can be sanctioned by the court. If you have experienced a bias motivated incident, reporting the behavior to the police is an option. Reporting can take many forms and doesn’t necessarily have to lead to the filing of criminal charges. Some people simply want to file an “informational” report with the intention of making the police aware of their situation but without pursuing charges. Other people are interested in having the police contact the person and give a verbal warning. At the same time, many people choose to file criminal charges. This might include getting names of witnesses, saving emails, text messages or voice messages related to the incident as well as taking pictures of injuries, damage, graffiti or supporting materials. You can also get copies of relevant medical records. OVA can talk with you about reporting issues, as well as help you make connections with the police if you want help in assessing the situation.

Reporting to the Office of Institutional Equity and Compliance

If the person who enacted bias against you is a CU student, faculty, or staff member, you can report to the Office of Institutional Equity and Compliance. The Office of Institutional Equity and Compliance investigates reported instances of bias under the Discrimination and Harassment policybased on protected class. If you would like to know more about the Office of Institutional Equity and Compliance process, you can contact OVA or the Office of Institutional Equity and Compliance, or look at their website. The Office of Institutional equity and Compliance can provide another avenue for reporting and may be able assist with an informal solution. The Office of Institutional Equity and Compliance process is different from criminal or civil processes. You can choose one or both (unless this is an intimate partner violence situation). You can contact the Office of Institutional Equity and Compliance anonymously to get a better understanding of how they might handle your situation, or OVA can help you with getting that assessment.

Confidential Reporting

If you do not want to or have not yet decided whether to report officially, you can still inform a confidential resource of bias related, violent or abusive experiences on this campus. Completing this form does not constitute a report to the University and will not initiate any law enforcement, judicial or administrative action.

How to Help

If someone you know is the target of bias, there are ways you may be able to help.

  • First, take the situation seriously. It is important that your friend or colleague feel believed and understood.
  • If you have been the target of a similar situation your experience may help. Your friend’s reaction may differ, and their choices may differ, but knowing that they aren’t alone can be helpful in itself.
  • If you haven’t been the target of a similar situation, you can listen, and then learn more about how bias impacts people (see links below).
  • Ask the person how they feel the situation is impacting their life. Are they having a hard time concentrating on school work? Do they feel they can no longer work productively at their job?
  • Encourage the person to keep a record of the behavior, including dates, places, times and witnesses.
  • Don’t investigate the situation or overreact. It is important that the person experiencing the bias have the opportunity to address the situation at their own pace.

Secondary Trauma

Secondary/Vicarious trauma can occur for those who work with trauma survivors and/or who are exposed to other’s traumatic situations.  Vicarious trauma can affect the following areas: physical, emotional, behavioral, cognitive, and spiritual.

It is important to notice changes in yourself after seeing and/or working close to other’s trauma.  Notice if your views start to incorporate the views of the survivor, this can increase with repeated exposure to other’s trauma. OVA provides free and confidential advocacy and counseling services to those supporting the survivor, also known as secondary survivors. It is important for you to have a place to process your own feelings and reactions to mitigate potential for secondary/vicarious trauma and in order to take the best care of yourself while supporting the survivor.

Common Signs of Secondary Trauma

  • You may question your basic beliefs about the world, safety, trust, justice
  • You may have a heightened awareness of the vulnerability and fragility of life
  • Survivors  may feel a sense of powerlessness and that could start to transfer to you
  • Feelings of isolation or alienation may develop.
  • Difficulty managing emotions
  • Difficulty making decisions
  • Difficulty managing the boundaries between yourself and others
  • Problems in relationships
  • Difficulty feeling connected with what is going on around and within you
  • Loss of meaning and hope
  • Physical manifistations: aches and pains, diffficulty sleeping, fatigue, anxiety, change in appetite

Prevention/Decreasing Secondary Trauma

  • Be aware of your symptoms of stress to prevent them from becoming severe.
  • Establish clear, realistic stress management goals and incorporate the planning and support needed.
  • Incorporate down time in your schedule.
  • Take deep breaths and/or do simple meditation.
  • Make sure to be eating regularly and including healthy foods and water.
  • Develop a support/social system, be it with friends, family, community members, counselors etc.
  • Exercise is a good stress reducing activity.
  • Sleep is very renewing, so try to get 7-8 hours of sleep a night.
  • You may want to limit your exposure to certain media, i.e., the news, newspapers etc.
  • Know your limits and when to ask for help, you do not have to do this alone.

Sudden Loss

Loss in itself is painful enough, but sudden loss (when someone dies accidentally, unexpectedly and/or violently) is shocking and the shock can double one’s pain and intensify grief.  A sudden loss may seem more painful, complicated and emotional.  

Challenges of sudden loss

  • There is no chance to prepare or to gradually absorb the change in your world
  • There is an increase in grief over the senselessness or unfairness nature of the death
    • Some feel cheated as there was no last good-bye
    • Feeling cheated can add to one’s despair and anguish
    • “If only . . .” is a common question one may ask themselves
  • There may be grief over the lack of dignity of the death
    • Feeling the deceased was denied a peaceful or natural death
  • The world can feel less safe
    • Feelings of disenfranchisement (the world is bad) and vulnerability may increase
    • Feeling fearful, uncertain, angry and/or frustrated with the world
    • It may be hard to watch TV, read the news, etc.
  • There may be feelings of guilt because you have survived
    • This is a normal feeling, even if it feels unreasonable
    • Taking some responsibility for the death is an attempt to get some control of the senselessness of the incident
  • When a younger person dies suddenly or violently the feeling of unnaturalness is heightened for some, “they still had so much life to live”
  • Some sudden losses have media coverage making the loss more public
    • Some feel a loss of privacy or information is misrepresented
    • Yet one may find themselves obsessively gathering/following the reports
  • There may also be more involvement of the criminal justice system
    • Negotiating autopsies, police reports, legal meetings/hearing can increase emotional turmoil
    • The legal system can also go on for some time, possibly delaying parts of the grieving process
  • Anger/rage feeling may be overwhelming
  • There may be a lack of control over memories and thoughts about the loss
  • Some may feel isolated
    • Not sure who to trust and lean on for support
